Cavendish Farms "Fun at the Table" Contest Official Rules

  1. HOW TO ENTER: No Purchase Necessary. The Cavendish Farms "Fun at the Table" Contest (the "Contest") commences at 12:01 am (ET) on November 2, 2009 and will end at 11:59 pm (ET) on January 31, 2010 (the "Promotional Period"). To enter go to www.funatthetable.com and select the Contest icon. Enter your e-mail address; correctly answer the mathematical skill-testing question without assistance of any kind whether mechanical or otherwise; read and accept the Official Rules; and select submit.
    1. If this is your first time visiting the website you will be required to complete the on-line Entry Form with your full name, full address, daytime telephone number, date of birth; (collectively, "Registrant's Information"); unselect the opt in box if you DO NOT wish to receive future news and information from the Sponsor; and select submit.  Upon receipt you will receive a "Thank you" message with directions on how to receive bonus entries (see Rule 2 below).
    2. If our system recognizes your e-mail address you will receive a webpage confirming that you have been entered into the Contest. Proceed to Rule 2 for how to receive extra entries.
  2. HOW TO RECEIVE EXTRA ENTRIES. You can receive an extra entry for each friend that you refer to the Contest who subsequently enters the Contest during the Promotional Period.  LIMIT:  Ten (10) extra entries per entrant.  Entries will only be earned if the Sponsor determines in its sole discretion that you have fully adhered to the Refer a Friend Policy below. If two or more entrants refer the same friend, only the entrant who first referred the friend to the Contest (as determined by the Sponsor in its sole discretion) will receive an extra entry. Referred friend(s) must enter the Contest by 11:59 PM (ET) on January 31, 2010 (the "Contest Closing Date"). The sole determinant of time for the purposes of receipt of an on-line entry will be the Sponsor's computer servers.
  3. REFER A FRIEND POLICY. "Friends" are those with whom you have a personal/professional relationship and who are eligible to enter the Contest. Names and e-mail addresses of referred friends will be used to send an e-mail using the referring entrant's e-mail address from Sponsor's server notifying them of the Contest, but, thereafter, will not be retained by Sponsor unless the referred friend chooses to enter the Contest. Prior to using the Refer a Friend feature, you must have the permission to use your friend's email address for the purpose of referring your friend to this Contest. You must not use the Refer a Friend feature for any other use other than to refer friends to the Contest. Without limitation, you must not use the feature to send emails: (i) to strangers; (ii) multiple referrals to the same friend; (iii) unsolicited e-mail; and (iv) "spam".  You must not ask or otherwise encourage referred friends to enter the Contest.
  4. LIMIT ON ENTRIES: You may use only one (1) e-mail address to participate in the Contest. LIMITS: One (1) entry per person per week during the Promotional Period (each a "Promotion Week") and a maximum of ten (10) entries from the Refer a Friend function during the Promotional Period. Each Promotion Week starts at 12:01 am (ET) on a Monday and ends at 11:59 pm (ET) on the following Sunday. Any person who is found to have entered more than once per Promotion Week (other than entries from the Refer a Friend function), or with more than one (1) e-mail address, will be disqualified and all entries received by such person during the Promotional Period will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Entries that are late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, that have been submitted through illicit means or do not conform with or satisfy any or all of the conditions the Official Rules will be judged void. All entries become the property of the Sponsor upon receipt and none will be returned.
  5. ELIGIBILITY: To enter, you must be a legal resident of Canada who has reached the age of majority in your province or territory of residence at the time of entry. Employees, officers, and directors (and members of their immediate families and the same household) of Cavendish Farms Corporation (the "Sponsor"), its affiliates (including, without limitation, its parent, sister and subsidiary companies), the independent contest organization, advertising or promotional agencies, suppliers of materials or services related to the Contest are not eligible to enter the Contest. For these Official Rules, "immediate family" means mother, father, sister, brother, son, daughter and spouse, including common law spouse, regardless of where they reside. The decisions of the Sponsor and independent contest organization are final and binding in all matters related to this Contest and the awarding of the Prize. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate.
  6. PRIZES: There will be a total of twenty-one (21) Prizes (each, a "Prize") available to be won.
    1. Grand Prize: There will be one (1) Grand Prize available to be won. The Grand Prize consists of a 22.5  cu ft Deluxe Stainless Steel Refrigerator ( model # RFG237AARS ) . Approximate retail value of the prize is $3,000 CDN including delivery and freight charges. In lieu of the described prize the winner may alternatively select $2,000 CDN. If the winner selects the $2,000 CDN the prize will be issued in the form of a cheque payable in the Winner's name as it appears on his/her Entry Form.
    2. Secondary Prizes: There will be ten (10) Secondary Prizes available to be won. Each Secondary Prize consists of ten (10) Cavendish Farms "From the Farm" FREE product coupons. Approximate total retail value of each Secondary Prize is $50.00 CDN. Each FREE product coupon entitles the consumer to purchase any Cavendish Farms "From the Farm" product up to a value of $5.00 CDN at any participating store in Canada. If the product value is less than $5.00 the difference will not be returned to the consumer. If the value of the product if more than $5.00 the difference will be charged to the consumer at the time of purchase. Coupons expire on December 31, 2010. Any coupons that are not redeemed by December 31, 2010 will not be replaced with new coupons. Transportation to and from the store is not included. The Sponsor is not responsible for product availability at any participating store.
    3. Third Prizes: There will be ten (10) Third Prizes available to be won. Each Third Prize consists of five (5) Cavendish Farms "From the Farm" FREE product coupons. Approximate total retail value of each Secondary Prize is $25.00 CDN. Each FREE product coupon entitles the consumer to purchase any Cavendish Farms "From the Farm" product up to a value of $5.00 CDN at any participating store in Canada. If the product value is less than $5.00 the difference will not be returned to the consumer. If the value of the product if more than $5.00 the difference will be charged to the consumer at the time of purchase. Coupons expire on December 31, 2010. Any coupons that are not redeemed by December 31, 2010 will not be replaced with new coupons. Transportation to and from the store is not included. The Sponsor is not responsible for product availability at any participating store.

    Prizes must be accepted as awarded without substitution and are not transferable or for resale and has no cash surrender value except where offered. The Sponsor reserves the right, in its sole and absolute discretion, and for any reason whatsoever, to substitute the Prize or any component of the Prize without liability.

  7. DRAWS: Random draws will be conducted from all eligible entries received during the Promotional Period at approximately 10:00 am (ET) in Oakville, ON on February 3, 2010. Odds of winning any Prize will depend on the total number of eligible entries received during the Promotional Period. The draw will be done in the following order: Grand Prize; Secondary Prizes followed by Third Prizes. Each Secondary and Third Prize selected entrants' answers to the mathematical skill-testing question must first be verified and if the answer is deemed to be correct the selected entrant will be declared a winner. See Rule 8 for delivery information for Secondary and Third Prize winners. The Grand Prize selected entrant will be contacted by email, courier or telephone within ten (10) business days of the draw as they will be required to complete the Sponsor's Declaration of Compliance with these Contest Rules and a Release of Liability and Publicity Release form as defined in Rule 9 and 10 below.
  8. SECONDARY AND THIRD PRIZE WINNER CONFIRMATION:  By accepting delivery of a Secondary or Third Prize, each Winner confirms compliance with the Official Rules, acknowledges that the Prize is not transferable and must be accepted as awarded with no substitutions in cash or otherwise and at Sponsor's sole discretion and has no cash surrender value, releases the Sponsor, its affiliates (including, without limitation, its parent, sister and subsidiary companies), advertising and promotional agencies, the independent contest organization, and all of their respective shareholders, directors, officers, employees and agents (collectively the "Releasees") from and against all liability in connection with the Contest and/or the awarding and/or use of the Prize, and consents to the use of his/her name, address (city and province), photographs, image, statements regarding the Contest or the Prize and/or voice, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest in any media whatsoever.
  9. GRAND PRIZE WINNER CONFIRMATION: To be confirmed a Grand Prize Winner, the selected entrant must: (i) reply to potential Winner notification within ten (10) business days of being contacted by email, mail, courier or telephone; (ii) correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematic skill-testing question to be administered by telephone during a pre-arranged, mutually convenient time; (iii) be in full compliance with these Official Rules; and (iv) sign and return via express mail or courier delivery within ten (10) business days of it being sent, the Sponsor's Declaration of Compliance with these Contest Rules and a Release of Liability and Publicity Release form ("Prize From"). In the event that the selected entrant cannot be contacted within ten (10) business days by mail, courier or telephone, the selected entrant will be disqualified at the sole and absolute discretion of the independent contest organization, his/her entitlement to receive the Prize will be forfeited, and an alternate eligible entrant will be randomly selected from the remaining eligible entries and the above process will be repeated. This process will be repeated until such time one (1) selected entrant is confirmed the winner ("Winner") and/or no more eligible entries are available.
  10. RELEASE OF LIABILITY AND PUBLICITY RELEASE FORM: Prior to receiving the Grand Prize, the Winner must complete and return the Sponsor's Declaration of Compliance and Release of Liability and Publicity Release Form (the "Form"). By completing and returning the Form, and accepting the Prize, the Winner confirms compliance with the Official Rules, acknowledges that the Prize is not transferable and must be accepted as awarded with no substitutions in cash or otherwise except where stated and at Sponsor's sole discretion and has no cash surrender value, releases the Sponsor, its affiliates (including, without limitation, its parent, sister and subsidiary companies), advertising and promotional agencies, the independent contest organization, and all of their respective shareholders, directors, officers, employees and agents (collectively the "Releasees") from and against all liability in connection with the Contest and/or the awarding and/or use of the Prize including, as set out below in the LIMITATION OF LIABILITY section, and consents to the use of his/her name, address (city and province), photographs, image, statements regarding the Contest or the Prize and/or voice, without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor with respect to the Contest in any media whatsoever. The signed Form must be returned within the time period specified on the Form or the Prize will be forfeited. The Sponsor or a designated agent will deliver the Grand Prize to the Winner within thirty (30) days of receiving the fully completed Form.
  11. LIMITATION OF LIABILITY: The Releasees do not assume any responsibility and the entrant releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the entrant's participation or attempted participation in the Contest, including, without limitation the selection and confirmation of the Winner, the administration of the Contest and the arranging, awarding and use of the Prize. Without limiting the generality of the forgoing, the Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Official Rules; (iii) any loss, damage, or claims caused by the Prize or the Contest itself; (iv) any failure of the website during the Promotional Period, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an entrant's or any other person's computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person's ability to participate in the Contest; (v) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise or (vii) any claims regarding the accepting, arranging, awarding or use of the Prize. Entry material/data that has been tampered with or altered is void.
  12. CONDITIONS OF ENTRY: By entering the Contest, entrants (i) agree to read and abide by these Official Rules including, without limitation, all eligibility requirements, and (ii) agree to be bound by the Official Rules and by the decisions o'f the independent contest organization, made in its sole and absolute discretion, which shall be final and binding in all matters relating to this Contest and the awarding of the Prize. Entrants who have not complied with these Official Rules are subject to disqualification. Sponsor reserves the right, in its sole and absolute discretion, to disqualify any entrant it finds to be: (a) violating the Official Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest or the Contest Website; (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person or (d) attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If Sponsor suspects that an entrant has engaged in an unsportsmanlike or disruptive manner, the entrant will be contacted as soon as practicable. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.
  13. DISPUTE REGARDING THE IDENTITY OF AN ENTRANT: If a dispute arises regarding who submitted an on-line entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of entry provided the name of the authorized account holder corresponds with the full name on the entry form. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at the Sponsor's sole and absolute discretion.
  14. FOR QUEBEC RESIDENTS: Any litigation respecting the conduct and awarding of the Prize may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of the Prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.
  15. GENERAL: This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. Except as expressly warranted herein, the Prize is provided "as is" without further warranty of any kind. The Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate, modify, or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux, to terminate the Contest and conduct a random draw from all previously received eligible entries.
  16. RULES GOVERN. In the event of any discrepancy or inconsistency between the Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to, the Contest entry form, the Official Rules shall prevail, govern and control.
  17. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. By entering this Contest electronically and voluntarily providing the Registrant's Information you consent and agree to Sponsor's collection and use of the Registrants Information to administer this Contest. If you consented on the entry form, the Sponsor may also use your Registrant's Information to contact you to promote draws, interactive features and contests similar to the Contest, promote opportunities to subscribe to Sponsor newsletters and promotional clubs, notify you about programs and special events. Your consent to Sponsor's use of Registrant's Information may be revoked at any time (without revoking your participation in the Contest or impairing your chances of winning) by sending an e-mail with the words "unsubscribe" in the subject line to service@cavendishfarms.com
